This may be a moot point but the domain expires on March 31st. Dash (the company) might be able to grab it at little cost.

If there isn't communication with the domain holder already I'd recommend waiting to see if it expires, first. Then buy it for cheap. If he renews it then send in the lawyer.

I wish he let it expire, but he is actively scamming people, he won't make that mistake
