Just checked SEC website. Looks like the commissioners have a closed meeting scheduled for Thursday 9 March. 2pm ET.

Interesting observation: The SEC needs a quorem of 2 commissioners to approve or reject a proposal. And currently there are only 2 of 5 commissioners in place.

So technically, if the acting chair (who is a republican and pro deregulation) wanted this to go through. All he has to do is not show up to the meeting. There is no quorem, and ETF goes through by default as they have run out of time to make a decision as per the Act.
